Insurers are bound by rate and form regulations, and are strictly governed on numerous underwriting and claims practices, including fraud. Our attorneys are well-versed in regulatory schemes applicable to all different types of insurers -- from life to property and casualty. We regularly consult with insurers to address compliance and represent our clients in investigations by regulators.
In addition, we have defended class actions that seek to prove a particular decision by an insurer is directed at a specific class of individuals. These class action claims require extraordinary management skills and experience due to the large numbers of claimants and extensive documents. We believe that every consumer fraud case must have a discovery plan that begins with the initial filing of discovery with the complaint. A protective order is often necessary to guard against proprietary information being disseminated. Some the recent matters we have handled include:
- Advising insurers on state licensing and approval for new product lines
- Representing insurers on matters before state regulators
- Working closely with an expert to defeat alleged "vanishing policy" and "vanishing premium" cases
